Section A - Promotion terms (applicable to all entrants)
The following promotion terms and conditions relate to the Ladbrokes Poker Cruise IV promotion. The tournament Promoter is Ladbrokes International Limited (Company no: 46808), 57-63 Line Wall Road, Gibraltar “Ladbrokes”. Entrants to the promotion must read the terms and conditions contained in Section A. Qualifiers must also read Section B. Section C is applicable to those who choose to buy-in to the cruise, plus anyone who receives or buys a place by way of transfer from a Qualifier.
Ladbrokes Poker Cruise IV (as defined below) will be operated by Royal Caribbean Cruises Ltd as Carrier, and/or Royal Caribbean Cruise Line A/S acting as disclosed agent for Royal Caribbean Cruises Ltd (the “Cruise Operator”). All tickets, vouchers and coupons for the Cruise will be issued by the Cruise Operator with the sole exception of the Cruise Ticket (as defined below). Passengers shall be subject to the Cruise Operator’s own booking and ticket conditions, and all arrangements made by Ladbrokes in respect of the tournament and cash poker games are subject to the terms and conditions of the Cruise Operator. The Cruise Operator’s booking and ticket terms and conditions contain limitations and exclusions of liability to any person who travels with the Cruise Operator. Ladbrokes recommends that you obtain and read copies of the Cruise Operator’s and these terms and conditions prior to participating in this promotion.
This promotion is not offered to you as a holiday package. Ladbrokes acts merely in the capacity of agent and accepts no responsibility or liability whatsoever for your travel arrangements (which will be subject to the relevant third party carrier’s own terms and conditions) and Ladbrokes does not accept any responsibility or liability whatsoever for your transfer and accommodation arrangements in the Port (as defined below) nor for the operation of the Vessel (as defined below).
In these terms and conditions:
“Cruise Place” means the place won by a Ladbrokes poker player entitling them to participate in the Ladbrokes Poker Cruise IV and certain rights and benefits set out in these terms and conditions.
“Guest” means the person as notified to Ladbrokes in writing that the Qualifier has nominated to be accompanying the Qualifier on Ladbrokes Poker Cruise IV.
“Qualifiers” means all persons who have successfully pre-qualified for a Cruise Place though Ladbrokes’s online tournaments.
“Passengers” means all persons on board the Ladbrokes Poker Cruise IV in possession of a Cruise Place and their guests (including the Qualifiers and Guests) but excluding Ladbrokes’ employees, agents or representatives.
The “Port” means the destination and arrival port of the Vessel, which is currently anticipated to be Ft Lauderdale Cruise Port, Florida.
The “Vessel” means the ship upon which the relevant Passengers participate in Ladbrokes Poker Cruise IV.
A1. The Cruise Place
All Qualifiers will be issued with a Cruise Place by Ladbrokes. The Cruise Place shall allow the Qualifier and one Guest accommodation on board a cruise departing from the Port, on Saturday 22 January 2011 and returning to the same Port on Saturday 29 January 2011 (“Ladbrokes Poker Cruise IV”) in the form of a single ocean view D class two berth cabin with balcony. In addition, all meals will be complimentary except where guests decide to make a reservation at one of the specialist restaurants on the ship. Drinks and any optional services must be paid for on board.
Any special accommodation requests must be notified in writing to Ladbrokes as soon as possible and in any event no later than 60 days prior to 22 January 2011. Upon receipt of such request, Ladbrokes will use its reasonable endeavours to liaise with the Cruise Operator to accommodate any requests, but cannot guarantee that any special cabin grades or facilities or any other request will be possible.
The Cruise Place shall also include a £950 travel and accommodation allowance (£425 for each of Qualifier and Guest) to contribute to the cost of return flights to and from the Port, and your overnight accommodation in the Port on the 21 January 2011 if such accommodation is required (the “Travel Allowance”). This amount is the maximum sum that Qualifiers and Guests are entitled to for any travel and accommodation requirements and Ladbrokes shall not cover any travel or accommodation costs that exceed the Travel Allowance.
Unless otherwise notified by Ladbrokes, the Travel Allowance will be paid into the relevant Ladbrokes accounts within 10 working days of qualification except where players qualify before 1 March 2010. All qualifiers before 1 March 2010 will receive their travel allowances by 10 March 2010.
Qualifiers and Guests must make their own flight, transfer and hotel arrangements. Passengers will not be permitted to board if they arrive less than one hour prior to the Vessel’s scheduled embarkation which is currently 17:00 EST on 22 January 2011. The Vessel’s scheduled embarkation time may be subject to change and Passengers are required to check times with the Cruise Operator before travelling.
A Cruise Place won by any person in the Ladbrokes on-line tournament is non-refundable, but may be transferred to another Ladbrokes poker player. Should a Cruise Place holder win more than one Cruise Place, that person may transfer any subsequent place(s) to another Ladbrokes poker player. Any proposed transferee poker player must hold an account with Ladbrokes Poker, and any such transfer must be notified to Ladbrokes in writing within 15 working days of the date upon which the Qualifier became entitled to the Cruise Place he/she wishes to transfer, otherwise the Cruise Ticket will be forfeited. Any such transfer will be also then be subject to the ‘Buy In Terms and Conditions’.
Ladbrokes, on behalf of the Cruise Operator, reserves the right to refuse entry at any time to any person for any reason whatsoever to the Ladbrokes Poker Cruise IV.
The winning of Cruise Places is subject to availability. Notwithstanding anything published or advertised to the contrary, Ladbrokes reserves the right to withdraw the Cruise Place as a prize in its on-line tournaments at any time for any reason whatsoever.
A2. The on-board Tournaments:
The minimum age limit for participants in any of the poker tournaments on board the Ladbrokes Poker Cruise IV is 18 years old.
Tournament Rules: In addition to these Terms and Conditions, Ladbrokes tournament rules (“the Tournament Rules”) will apply, a copy of which will be available on board on request. You agree to comply with the Tournament Rules at all times and you understand that Ladbrokes reserves the right to amend the Tournament Rules at any time for any reason whatsoever.
Only Passengers who hold a Ladbrokes Cruise Place and their Guests will be eligible to participate in the poker provided on board the Vessel by Ladbrokes, subject to the relevant participating Passenger and/or Guest having a Ladbrokes Poker account at the relevant time.
Prize payments: All Multi-Table Tournament prize payouts will be credited to the participants’ Ladbrokes Accounts within ten (10) working days after the cruise is completed, that is, by Friday 11 February 2011 unless otherwise notified by Ladbrokes. No cash alternatives will be given on board the Vessel or thereafter. Any Guest, who does not have a Ladbrokes account, must open one in order to receive any payouts from Multi-Table tournament(s) held on board.
All scheduled tournament prize pools (total) will have 5% deducted as a fee to the poker operator. Prize pools for all scheduled tournaments will be annunced once on the ship.
Tournament refunds: Any player who has pre-registered for a tournament, but is already participating in a previous tournament, will receive a full refund for the tournament that they cannot participate in. Refunds will be paid directly into players Ladbrokes Poker accounts by Friday 11 February 2011 unless otherwise notified by Ladbrokes.
Non Attendance: No refunds of poker tournament money will be made to you if you are unable to join the Vessel, for any reason whatsoever.
Non transferability: Non transferability: Places in the tournaments are not transferable (subject to the above provisions relating to the transfer of Cruise Places).
Cash Games: All poker chips for cash games and single table tournaments will be purchased from the casino cage on board the Vessel. Purchases of chips will be through the use of the cashless ship system administrated by the Cruise Operator. All cash game winnings are the responsibility of the player and cannot be paid into Ladbrokes accounts on the Vessel, but may be credited back to your credit card or ship balance through the casino cage.
Cancellation: Ladbrokes has the right to cancel or re-schedule any tournaments for operational, commercial or any other reason whatsoever.
A3. Liability of Ladbrokes as Promoter:
Except in respect of death and personal injury caused by Ladbrokes’ own negligence, Ladbrokes limit their liability for any losses of any nature to the fullest extent permitted by law. Ladbrokes acts merely in the capacity of agent in relation to the cruise places and accepts no responsibility or liability whatsoever for your travel arrangements (which will be subject to the relevant third party carrier’s own terms and conditions)
A4. Data information and publicity:
By participating in Ladbrokes Poker Cruise IV you agree to participate in reasonable publicity, marketing, advertising and promotional materials, including betting markets and television and internet media coverage. Main event reports will also feature names and alias of the winners. You also agree that Ladbrokes requires pertinent personal information including without limitation name, address, any health, medical, disability, or dietary requirements or any other special needs to administer your reservation effectively. You accept that Ladbrokes may pass this information on to other relevant individuals such as travel agents, hotels, airlines or other transport providers, security and/or credit verification companies, credit and debit card companies or any governmental or public authorities either as required by law or regulation or if required by such other bodies. You accept that this may involve the transfer of information to other countries outside the European Economic Area which may not have such robust requirements regarding data protection as the UK. You recognise that the Cruise Operator or actual carrier will not be able to process your booking effectively without your permission to transfer this personal information.
A5. Applicable Law and Jurisdiction:
These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with English law. All disputes arising out of, under, or in connection with those terms and conditions shall be subject to the exclusive jurisdiction of the courts of England.
Section B: Cruise Place Terms (applicable to all Qualifiers)
Ladbrokes acts as agent for the Cruise Operator.
B1. The Cruise:
Cancellation of the cruise: In certain circumstances, as a gesture of goodwill, Qualifiers, or Passengers who received their Cruise Place by way of a transfer from a Qualifier made in accordance with these terms and conditions, shall receive the following:
- (a) if the cancellation occurs prior to the date on which Ladbrokes has paid the Travel Allowance, a refund of £2,550 to represent the cash value of the Cruise Place less the Travel Allowance & Poker bankroll; or
- (b) if the cancellation occurs after the date on which Ladbrokes has paid the Travel Allowance, a refund of £2,550 to represent the cash value of the Cruise Place less the Travel Allowance & Poker bankroll together with a refund of any travel costs to and from the Port reasonably and properly incurred in order to participate in the Ladbrokes Poker Cruise IV, provided that (i) reasonable evidence of such costs is provided to Ladbrokes; and (ii) the relevant costs are non-refundable at the time of Ladbrokes’ cancellation;
Such payments are made at the absolute discretion of the promoter, dependant upon the cause of the cancellation of the cruise.
Alcohol purchase and consumption: On board the Ship you will be required to abide by US law for alcohol purchase and consumption as well as the Cruise Operator’s instructions.
B2. Insurance and Travel Information:
All travel information is given as general guidance, no responsibility or liability is accepted by Ladbrokes in relation to your reliance upon it. Rules and regulations often change and it is your responsibility to check the requirements applicable to you by directly contacting the relevant authority or organization.
Insurance: All Passengers are solely responsible for arranging their own travel (flight and transfer arrangements) if you participate in this Promotion and for taking out appropriate personal travel insurance before departure. This must include as a minimum cover for the cost of cancellation by each Passenger and the cost of assistance including repatriation in the event of accident or illness. You are also solely responsible for ensuring that the insurance cover taken out by you is sufficient suitable and adequate for your individual needs having regard to the required scope and risks and for purchasing additional or alternative insurance if required. We recommend that you contact your travel agent or an independent insurance broker for details of suitable policies.
It is a condition of your Cruise Place that you will take out insurance (at your sole expense) to cover yourself and all the members of your party and for such insurance to be in force for the period from the earlier of: (i) your embarkation on board the Vessel; and (ii) or your check-in for the outward flight preceding the cruise, until the later of: (i) your disembarkation from the Vessel; and (ii) the arrival of your return flight at its destination following the cruise.
Such insurance shall be of a comprehensive nature from a reputable insurer, and shall include cover for the following risks:
- (a) Death or personal injury;
- (b) Cancellation of the cruise;
- (c) Theft or loss of or delay or damage to your property (including your baggage);
- (d) Medical, dental, repatriation and other similar or related costs; and
- (e) Additional accommodation or transportation costs (not provided for in our contract).
Any costs, liabilities or charges reasonably incurred by Ladbrokes for or on your behalf in respect of any medical, dental or similar care, repatriation, accommodation or transportation not provided for in these Terms and Conditions or any other expense shall be repaid by you to Ladbrokes on demand, whether or not such sums are recoverable by you under your insurance.
Cruise Registration: Cruise lines are required to obtain information about guests in advance of their cruise taking place. Without this information the Cruise Operator will not be able to give authorisation for you to join the cruise. You must, therefore, complete the registration form you will be sent after qualification or entry. If you qualify before June 2010 you will not be required to submit this information until after this date. All information must correspond with your passport or travel documentation. If you fail to supply the details requested for you and your guest fully and accurately, you may not be permitted to board the Vessel and/or outward and/or return flight. All passenger information (lead name and guest) must be supplied via the registration form by 25 November 2010 at the latest to enable us to issue your Cruise tickets.
Travel documentation, Visa, Information and Health Requirements: It is your sole responsibility to identify all travel and health documents and to be in possession of all necessary appropriate valid travel and health documents for you and your guests before departure. This includes passport, visas, inoculation and family legal documents. You must pay all costs incurred in obtaining such documentation. If failure to have any necessary travel or other documents results in fines, surcharges or other financial penalties being imposed on Ladbrokes and/or the Cruise Operator, you will be responsible for reimbursing us accordingly. Failure to present the necessary documents and/or visas at the airport / pier / ports of call could result in denied boarding. We are unable to guarantee your place in any of the Poker Tournaments if you are denied entry to the US or embarkation to the ship.

Pre-Travel Authorization Program for U.S. Bound Travellers from Visa Waiver Countries: All travellers, regardless of age, from Visa Waiver Program (VWP) countries will be required to complete an online application prior to boarding a carrier by air or sea to the United States under the VWP. All eligible travellers who wish to travel under the Visa Waiver Program must apply for authorisation via the Electronic System for Travel Authorization (ESTA) website https://esta.cbp.dhs.gov.
A third party, such as a relative or travel agent will be permitted to submit an ESTA application on behalf of a VWP traveller. The DHS recommends that an ESTA approval be obtained as soon as a VWP traveller begins to plan a trip to the United States, and no later than 72 hours before departure. Should the information you provided change after receiving your approval, updating your application online is easy.
ESTA will determine almost immediately in many cases if an individual is eligible for VWP travel. Possible website responses include: Authorization Approved, Travel Not Approved or Authorization Pending. In the event that an ESTA applicant is denied authorization to travel to the United States under VWP he or she will be referred to www.travel.state.gov for information on how to apply for a visa to travel to the United States.
Applicants who receive an Authorization Pending response will need to check the Web site for updates within 72 hours to receive a final response.
An approved ESTA travel authorization is:
- valid for up to two years or until the traveller’s passport expires, whichever comes first
- valid for multiple entries into the U.S be it for business or pleasure.; and
- not a guarantee of admissibility to the United States at a port of entry.
ESTA approval only authorizes a traveller to board a carrier for travel to the U.S. under VWP (Visa Waiver Programme). In all cases, U.S. Customs and Border Protection (CBP) officers make admissibility determinations at U.S. ports of entry. Health / Inoculation: You must ensure that you are medically and physically fit for travel. The Centres for Disease Control (CDC) http://wwwnc.cdc.gov/travel and the World Health Organization (WHO) www.who.int/vaccines-diseases, provide guidelines as to which vaccinations are required in each country. In many cases inoculations are recommended but in some circumstances they are required. You should check with your health care professional for guidance. Please contact your G.P. for advice and the most up-to-date health requirements for all destinations of the cruise. Information on health is also contained in the department of Health leaflet T6 (Health Advice for Travellers) available from your local Department of Health Office and most Post Offices.
Refusal to travel: If in the opinion of the Cruise Operator or the opinion of the Ship’s Master or doctor, it appears that a Passenger is or is likely to become unfit to travel for any reason or be or likely to become a risk or danger to themselves or others or any property or behave in such a way so as to cause or be likely to cause upset, distress or disturbance to any third party, the Cruise Operator and the Ship’s Master is entitled to, without prior notice, to refuse to allow any Passenger and their guest to travel and to terminate his/her cruise at any time. In such circumstances the Passenger will be liable for any costs, liabilities, expenses, taxes or other costs that result from such termination and No compensation or refund will be paid in respect of such termination. Following such termination, Ladbrokes as Promoter will have no further responsibility or duty towards the Passenger and he/she should address any rights of redress against the Cruise Operator.
Pregnancy: Any female who is more than 27 weeks pregnant by the beginning of the date of intended travel will not be allowed to travel. It is a further condition of the promotion that if you are or will become at any time during the Cruise between 24 and 26 weeks pregnant you will provide to Ladbrokes prior to the commencement of the Cruise a letter from your general practitioner confirming that you are fit to travel. This must be sent to us at least 30 days before departure. You are invited to consult your doctor prior to departure for the most recent guidance on travel for pregnant women.
Security measures: Due to enhanced procedures by the United States Immigration and Naturalization Service, guests departing the ship at the end of their cruise may be subject to possible delay. You may also experience long delays coming through Immigration on arrival. Due to increased airport security measures, please ensure that any sharp items, including scissors, razor blades, nail clippers, tweezers and knitting needles are packed in your check-in luggage and not your hand luggage. You must also ensure you comply with current regulations in relation to carrying liquids through the airport and on board the flight. You should check with your airline for their specific requirements at the time of travel.
Luggage: The Cruise Operator provides a generous allowance for luggage on board the Ship and before you travel you will receive special luggage labels to use. However, the size and weight of your luggage you bring to the US will be dictated by your selected airline, so please do check with them before you travel.
What Not To Pack: The following items are not allowed onboard the Cruise Operator’s ships and will be confiscated upon being found: Electrical Transformers, Coffee Makers, Candles, Irons, Illegal Drugs, Flammable Liquids and Explosives, such as fireworks. For security purposes, we also recommend not packing any valuables (such as jewelry) in your checked luggage.
Section C – Buy in Terms and Conditions (applicable to all Buy- Ins)
The Booking Terms and Conditions in this Section C, together with any other information brought to your attention before you booked your package, form the basis of your contract with Ladbrokes International Limited (Company no: 46808), 57-63 Line Wall Road, Gibraltar, hereafter "Ladbrokes", “we” or “us”. Please read them carefully as they set out our respective rights and obligations and all Poker Cruise Buy-In bookings are accepted by Ladbrokes subject to these Booking Conditions. In these Booking Conditions references to "you" and "your" include the lead-named person on the confirmation invoice and all persons on whose behalf a booking is made (including anyone who is added or substituted at a later date). In these Booking Conditions, unless the context otherwise requires, words in the singular shall include the plural and vice versa.
Once your Poker Cruise has been confirmed we will accept responsibility for it in accordance with these Booking Conditions as an "Organiser" under the Package Travel, Package Holidays and Package Tours Regulations 1992.
C1. Making your booking
All bookings are subject to availability. You must be at least 18 years old at the time of booking. You must contact the Ladbrokes Poker Team to request a Buy In place on the Poker Cruise. You will then be asked to lodge the appropriate amount in your poker account, and send us an email to confirm that you authorise Ladbrokes to withdraw the funds. Payment can be made using cash or points. The full cost of the package is payable from your poker account at the time of booking. After we have received your payment and issued a confirmation email containing all relevant documentation, a contract exists between you and us, effective from the date printed on the invoice.
We have the right to refuse any booking prior to the issue of your written confirmation. If we do this, we will tell you in writing and promptly refund any money you have paid to us/credit you with a refund of points. In this case we shall not have any liability towards you. As soon as your confirmation is received, you must check the details carefully. If anything is not correct you should tell us immediately. If you fail to pay any amount owed by the date it is due, we are entitled to cancel your booking and the cancellation charges set out in Clause 5 below will apply.
C2. Pricing
Prices may be increased or decreased and corrections made to errors in advertised prices at any time before your Poker Cruise booking is confirmed. The price of your Poker Cruise will be confirmed at the time of booking. As changes and errors occasionally occur, you must check all details carefully. All prices quoted or otherwise advised to you include all charges and any UK taxes or governmental levies that apply to your Poker Cruise at the time of booking.
When the price of your chosen arrangements has been confirmed, then, subject to the correction of errors, we will only increase or decrease the price in the following circumstances. Price increases or decreases after booking will be passed on by way of a surcharge or refund. A surcharge or refund (as applicable) will be payable, subject to the conditions set out in this clause, if our costs increase or decrease as a result of (as applicable) transportation costs, dues, taxes or fees payable for services such as landing taxes or embarkation or disembarkation fees at ports or any changes in the exchange rates which have been used to calculate the cost of your Poker Cruise. Even in the above cases, only if the amount of the increase in our costs exceeds 2% of the total cost of your Poker Cruise (excluding any amendment charges) will we levy a surcharge. If any surcharge is greater than 10% of the cost of your Poker Cruise (excluding any amendment charges), you will be entitled to cancel your booking and receive a full refund of all monies you have paid to the Company (except for any amendment charges). Should the price of your Poker Cruise go down due to the changes mentioned above, by more than 2% of your Poker Cruise cost, then any refund due will be paid to you. However, please note that travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place.
You have 14 days from the issue date printed on the surcharge invoice to tell us if you want to cancel your Poker Cruise. You will then receive a refund of the total price paid, less an administration charge of £20. If you do not tell us that you wish to do so within this period of time, we are entitled to assume that you will pay the surcharge. Any surcharge must be paid with the balance of the cost of the Poker Cruise or within 14 days of the issue date printed on the surcharge invoice, whichever is the later. We promise not to levy a surcharge within 30 days of the start of your Poker Cruise. No refunds will be made within this period either.
C3. Your financial security
The Package Travel, Package Holidays and Package Tours Regulations 1992 require us to provide security for the monies that you pay for the package Poker Cruises booked and for your repatriation in the event of our insolvency. This security is provided by an insurance policy which, in the unlikely event of our insolvency, will ensure that you are not stranded abroad and will arrange to refund any money you have paid to us for an advance booking.
C4. Changing or transferring your booking
Your Poker Cruise booking may be sold or transferred to another Ladbrokes poker player. Any proposed transferee poker player must hold an account with Ladbrokes and have a Poker alias, and any such transfer must be notified to Ladbrokes in writing and be approved by Ladbrokes. Ladbrokes reserve the right to refuse any transfer of booking. Any such transfer will be also then be subject to these ‘Buy In’ Terms and Conditions.
If you wish to change any part of your booking after our confirmation invoice has been issued, you must inform us in writing as soon as possible. Whilst we will do our best to assist, we cannot guarantee that we will be able to meet your requested change. Where we can meet a request, all changes will be subject to any applicable rate changes or extra costs/administration fees incurred. Where we are unable to assist you and you do not wish to proceed with the original booking we will treat this as a cancellation by you and cancellation fees will be payable.
C5. If you cancel your booking
If you have to, or wish to, cancel your Poker Cruise booking, you must immediately contact us and then confirm your cancellation. The day we receive your telephone notification of cancellation is the date on which your booking is cancelled. If you cancel, a cancellation charge will be levied as shown in the following table.

If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to reclaim these charges.
C6. Cancellations or changes by us
It is unlikely that we will have to make changes to your booking but occasionally, as we make the arrangements many months ahead, we may have to make changes both before and after bookings have been confirmed and/or cancel confirmed bookings. Whilst we always try to avoid changes and cancellations, we reserve the right to do so at any time. Occasionally we have to make a significant change to your booking. If a significant change or cancellation of your booking becomes necessary, we will inform you as soon as is reasonably possible before departure. All other changes are treated as "minor" in which case we shall have absolute discretion as to whether you are notified. If we have to make a significant change or cancel your booking, and provided that there is time to do so before departure, we will offer you three options:
- a) Accepting the alternative booking arrangements as offered to you; or
- b) Cancelling your Poker Cruise booking (together with a refund of any sums paid).
Following our offer of the alternative booking arrangements, you must notify us of your choice within a reasonable time. If you fail to do so we will assume that you have chosen to accept the alternative booking arrangements. The above options are not available where any change is a minor one or where the changes or cancellation by us arises out of alterations to the confirmed booking requested by you. In addition, if we make a significant change or cancel your booking within 8 weeks before the date of departure we will pay you compensation as set out in the table below subject to the following exception: no compensation can be paid and no liability beyond offering you the above options (where applicable) can be accepted where we are forced to make a change or cancellation as a result of unusual or unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised. Such circumstances may include, but are not limited to those listed under "force majeure" at clause 9 below.

The above sets out the maximum extent of our liability under this clause and we regret we cannot meet any expenses or losses you may incur as a result of inconvenience suffered.
C7. Complaints
If a problem occurs whilst you are onboard the cruise, you must inform the cruise staff and the Ladbrokes Security staff immediately so that the matter can be put right. If they cannot resolve the problem to your satisfaction at the time, you must also contact us immediately by telephoning our offices, so that we are given the opportunity to help. In the event that a complaint cannot be resolved at the time, you must write to us within 28 days of return to the UK giving all relevant information. PLEASE NOTE: - Failure to take these steps will hinder our ability to resolve the problem and/or investigate it fully and in consequence, your rights under the contract may be affected. We regret we cannot accept liability for any claims which are not notified to ourselves and/or our suppliers strictly in accordance with this clause.
C8. Our liability to you
We will accept responsibility for your Poker Cruise as an “organiser” under the Package Travel, Package Holidays and Package Tours Regulations 1992 as set out below. Subject to the other provisions of this Clause 9, we accept responsibility for ensuring that your travel arrangements, which you book with us, are supplied as described by us. If, after departure, any part of your Poker Cruise is not provided as promised, due to the fault of our employees, agents or suppliers, we will pay you appropriate compensation, if this has affected the enjoyment of your Poker Cruise. However, our liability in all cases shall be limited to a maximum of twice the value of the element not supplied. The level of such compensation will take into account all relevant factors including the invoice price of the Poker Cruise, any steps it was reasonable for you to take to minimise the inconvenience/damage suffered and the extent to which the deficiency or improper performance can have affected the your enjoyment of the Poker Cruise. Please note, no liability will be accepted for any loss of potential winnings at any table, event or tournament during the poker cruise if you are unable to participate for any reason whatsoever, or if any table or tournament does not take place.
Please note that we will not be liable for any injury, illness, or death or consequent losses suffered by you or any member of your party, unless you are able to prove that such injury or illness was caused by lack of reasonable care and skill on the part of ourselves or our suppliers in the performance of our obligations under our contract with you. It is a condition of the payment of compensation that you notify us of any complaint or claim strictly in accordance with clause 7 and, further, assign to us any rights that you may have against any third party in connection with your claim. You must co-operate with us and our insurers in this regard. If you suffer a personal injury, death or serious difficulties as the result of an activity which does not form part of the package you booked with us - including for example any additional services or facilities provided to you by a hotel or any other supplier which was not included as part of the original contract between us – we will not be liable to pay you any compensation but will offer you such advice and guidance as is reasonable in all the circumstances provided we are advised of the incident within 90 days of the occurrence. We will not be responsible where you do not enjoy the Poker Cruise or suffer any other problems because of a reason which you did not make us aware of when the Poker Cruise was booked.
In all claims of whatever nature we will not be liable where the alleged loss or damage results from any of the following:
- i. the fault of the person affected or any members of their party or
- ii. the fault of a third party not connected with the provision of your Poker Cruise which we could not have predicted or avoided or
- iii. an event or circumstances which we or the supplier of the service in question could not have predicted or avoided even after taking all reasonable care or
- iv. the fault of anyone who was not carrying out work for us (generally or in particular) at the time.
Important notice in respect of limits on liability.
Our liability will also be limited in accordance with and/or in an identical manner to
- (a) The contractual terms of the companies that provide the transportation for your travel arrangements. You acknowledge that all of the terms and conditions contained in those 'Conditions of Carriage' form part of your contract with us, as well as with the transport company and that those 'Conditions of Carriage' shall be deemed to be included by reference into this contract; and
- (b) Any relevant international convention, particularly the Athens Convention in respect of travel by sea and the Paris Convention in respect of the provision of accommodation, which limit the amount of compensation that you can claim for death, injury, delay to passengers and loss, damage and delay to luggage. We are to be regarded as having all benefit of any limitation of compensation contained in these or any conventions.
You can ask for copies of Royal Caribbean’s contractual terms, or the international conventions, from our offices.
The promises we give to you regarding the services we have agreed to provide or arrange as part of the contract, and the laws and regulations of the country in which your claim or complaint occurred, shall be used as the basis for ascertaining whether or not the services in question have been properly provided. If the services in question which caused the claim or complaint complied with the local laws and regulations applicable to those services at that time, the services shall be treated as having been properly provided. Such shall be the case even if the services did not comply with the laws and regulations of the UK which would have applied if those services had been provided in the UK.
Where we are found liable for loss of and/or damage to any luggage or personal possessions (including money), the maximum amount we will have to pay you and your party is £25 per person in total.
C9. Force majeure
We will not accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected, or you otherwise suffer any loss or damage due to circumstances that come under the definition of 'force majeure'. In these booking conditions 'force majeure' means any event that we or the supplier of the services in question could not foresee or avoid even with all due care. Such events include but are not limited to war, the threat of war, insurrection, riots, strikes, civil action decisions by governments or governing authorities, natural disaster, bad weather, technical or maintenance problems with the transport, criminal and terrorist acts or similar circumstances beyond our control.
C10. Special requests
If you have any special requests you must advise us at the time of booking and confirm them in writing. Although we will endeavour to pass any reasonable requests on to the relevant Supplier, no guarantees can be given that any request will be met. Confirmation that a special request has been noted or passed on to the Supplier, or the inclusion of the special request on your written confirmation or any other documentation, is not confirmation that the request will be met. Failure to meet any special request will not be a breach of your contract. Conditional bookings cannot be accepted ie: any booking which is specified to be conditional on the fulfilment of a particular request.
C11. Accuracy of Promotional Material
All information contained in any of our promotional material, eg brochures, advertisements, mailshots, websites and e-shots, is based on information available at the time of publication. We reserve the right to change any information before your booking is confirmed and the amended information will then form part of your contract with us. Whilst every effort is made to ensure the accuracy at the time of printing, regrettably errors do occasionally occur. We reserve the right to correct errors prior to confirming your booking.
C12. Behaviour
We reserve the right within our reasonable discretion to terminate the Poker Cruise, without notice, if your conduct or behaviour is disruptive in any way and/or affects the enjoyment of other holidaymakers. We shall not accept liability for any extra costs incurred by you as a result of our doing so, and no refund will be paid to you.
C13. Insurance
It is a condition of your contract with us that you have insurance cover for the duration of your Poker Cruise, and that it is adequate for your needs. We do not check insurance policies; however we reserve the right to request written details (insurer’s name, policy number and emergency contact number) of your policy. You are responsible for indemnifying us in full in the event that we incur any losses or expenses arising out of your failure to take out adequate insurance cover.
C14. Disabilities and medical problems
If you have any medical problem or disability that may affect your booking please tell us before you confirmyour booking and give us full details in writing as early as possible before you travel. If we reasonably feel unable to properly accommodate your particular needs we reserve the right to decline or cancel the reservation.
C15. Passports and visa information
It is your responsibility to ensure that you and all members of your party are in possession of all necessary travel and health documents before departure. All costs incurred in obtaining such documentation must be paid by you. We will not accept any liability if you or any members of your party are refused entry onto any transport or into any country due to the failure on the part of the person concerned to carry or supply correct documentation. Please see our FAQ section for further information. All information is for guidance only and you must check the relevant websites to check the up to date advice before you travel.
C16. Excursions
Excursions or other tours that you may choose to book or pay for independently before you travel or whilst you are on the Poker Cruise are not part of the Poker Cruise provided by us. For any such excursion or other tour that you book your contract will be with the operator of the excursion or tour and not with us. We are not responsible for the provision of the excursion or tour or for anything that happens during the course of its provision by the operator.
C17. Governing law
It is agreed that any dispute, claim or other matter which may arise in relation to your booking will be governed by English Law and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales. You may however, choose the law and jurisdiction of Scotland or Northern Ireland if you wish to do so.
