Important Note:
Only holders (and their guests) of Cruise Tickets that have been won or bought from Ladbrokes will be entitled to participate in the Ladbrokes operated Poker on board the ship. To confirm, holders of tickets purchased directly from RCCL will not be allowed access to the Ladbrokes areas and/or events on board the ship.
The following terms and conditions form the basis of your contract with the promoter of this event, Ladbrokes International Ltd, 5th floor, Europort, Gibraltar “Ladbrokes”.
Ladbrokes Poker Cruise III will be operated by Royal Caribbean Cruises Ltd as Carrier, and/or Royal Caribbean Cruise Line A/S acting as disclosed agent for Royal Caribbean Cruises Ltd (the “Cruise Operator”). The Contract for the Cruise will be between the Passenger and the Cruise Operator. All ticket, vouchers and coupons for the Cruise will be issued by the Cruise Operator with the sole exception of the Cruise Ticket. Passengers shall be subject to the Cruise Operator’s own booking and ticket conditions, and all arrangements made by Ladbrokes in respect of the tournament and cash poker games are subject to the terms and conditions of the Cruise Operator. The Cruise Operator’s booking and ticket terms and conditions contain limitations and exclusions of liability to any person who travels with the Cruise Operator. You are specifically referred to the “Liability of Ladbrokes as Promoter” section of these Terms and Conditions, which set out the exclusions and limitations of liability for Ladbrokes. Ladbrokes recommends that you obtain copies of these terms and conditions prior to participating in this Promotion.
This promotion is not offered to you as a holiday package. Ladbrokes accepts no responsibility or liability whatsoever for your travel arrangements (which will be subject to the airline’s own terms and conditions) nor does Ladbrokes accept any responsibility or liability whatsoever for your transfer and accommodation arrangements in New York nor for the operation of the Vessel.
Ladbrokes, including subsidiary companies, its officials, employees, agents or representatives shall not be liable to any Passengers for loss, damage, delay, cancellation or any additional expense, suffered by any passenger whatsoever, or for any cause beyond Ladbrokes’s control. In the event that Ladbrokes are found liable to a Passenger on any basis, all exceptions, exemptions, defences, immunities, limitations of liability, indemnities, privileges and conditions granted or provided for the benefit of the Cruise Operator set forth in the booking and ticket terms and conditions of the Cruise Operator shall also apply to and be for the benefit of Ladbrokes including subsidiary companies, its officials, employees, agents or representatives.
In these terms and conditions:
“Cruise Ticket” means the ticket either won or bought into directly by Ladbrokes poker players entitling them to participate in the Ladbrokes Poker Cruise III and certain rights and benefits set out in these terms and conditions.
“Guest” means the person as notified to Ladbrokes in writing that the Qualifier has nominated to be accompanying the Qualifier on Ladbrokes Poker Cruise III.
The “Main Event” means the $2,500 buy-in poker tournament to be held on board Ladbrokes Poker Cruise III.
“Qualifiers” means all persons who have successfully pre-qualified for a Cruise Ticket though Ladbrokes’s online tournaments.
“Passengers” means all persons on board the Ladbrokes Poker Cruise III in possession of a Cruise Ticket and their guests and excluding employees, agents or representatives of Ladbrokes.
The “Vessel” means the Ship upon which the Passengers may be travelling to participate Ladbrokes Poker Cruise III.
1. The Cruise Ticket
All Qualifiers will be issued with a Cruise Ticket by Ladbrokes. The Cruise Ticket shall allow the Qualifier and one Guest accommodation on board a cruise departing from Cape Liberty Cruise Port, New Jersey on Friday 25 January 2008 and returning to the same port on Sunday 3 February 2008 (“Ladbrokes Poker Cruise III”) in the form of a single ocean view E2 class two berth cabin with balcony. In addition, all meals will be complimentary.
Any special accommodation requests must be notified in writing to Ladbrokes a soon as possible and in any event no later than 60 days prior to 25 January 2008. Upon receipt of such request Ladbrokes will reasonably endeavour to accommodate any requests, but cannot guarantee that any special cabin grades or facilities or any other request will be possible.
The Cruise Ticket shall also include a $1,700 travel and accommodation allowance ($850 for each of Qualifier and Guest) to contribute to the cost of return flights to and from New York, and your overnight accommodation in New York on the 24 January 2008 if such accommodation is required (the “Travel Allowance”). This amount is the maximum sum that Qualifiers and Guests are entitled to for any travel and accommodation requirements and Ladbrokes shall not cover any travel or accommodation costs that exceed the Travel Allowance.
The Travel Allowance will be paid into Ladbrokes accounts within 10 working days of qualification.
Qualifiers and Guests must make their own flight, transfer and hotel arrangements. Ladbrokes accept no liability whatsoever for late arrival due to flight or transport cancellation or delays, strikes or for any other reason whatsoever. Passengers will not be entitled to compensation if they arrive less than one hour prior to the Vessel’s scheduled embarkation which is currently 16:00 EST on 25 January 2008. The Vessel’s scheduled embarkation time may be subject to change and Passengers are required to check times with the Cruise Operator before travelling.
The first Cruise Ticket won by any person in Ladbrokes on-line tournament is non-refundable, but may be sold or transferred to another Ladbrokes poker player. Should a Cruise Ticket holder win more than one Cruise Ticket, that person may: 1) Convert it into a $5,500 Festival Ticket; 2) Purchase a second Cruise Ticket; or 3) Transfer the subsequent ticket to another Ladbrokes poker player of their choice (provided that such transferee holds an account with Ladbrokes Poker) by notifying Ladbrokes in writing within 15 working days of the date upon which the Qualifier became entitled to the Cruise Ticket he/she wishes to transfer, otherwise the Cruise Ticket will be forfeited.
The $5,500 Festival Ticket comprises $4,600 of buy-ins for all five Festival tournaments and a $900 credit to the players account 7 days prior to Cruise commencing – Friday 18th January 2008.
Should a Cruise Ticket holder who is not already registered for the Main Event also win a Cruise Combo Package, that person may: 1) Transfer the subsequent ticket to another Ladbrokes poker player of their choice (provided that such transferee holds an account with Ladbrokes Poker) by notifying Ladbrokes in writing within 15 working days of the date upon which the Qualifier became entitled to the Cruise Ticket he/she wishes to transfer, or 2) receive an entry into the $2,500 Main Event and a $6,500 cash refund, otherwise the Cruise Combo Ticket will be forfeited.
Should a Cruise Ticket holder who is already registered for the Main Event also win a Cruise Combo Package, that person may: 1) Transfer the subsequent ticket to another Ladbrokes poker player of their choice (provided that such transferee holds an account with Ladbrokes Poker) by notifying Ladbrokes in writing within 15 working days of the date upon which the Qualifier became entitled to the Cruise Ticket he/she wishes to transfer, or 2) receive a $9,000 cash refund, otherwise the Cruise Combo Ticket will be forfeited.
Ladbrokes reserves the right to refuse entry at any time to any person for any reason whatsoever to the Ladbrokes Poker Cruise III.
Any person that wishes to directly purchase the right to participate in the Ladbrokes Poker Cruise III rather than qualify for a Cruise Ticket in Ladbrokes on-line tournament shall be entitled to purchase such rights for the cost $3,800 which is the value of the full Cruise Ticket minus the Travel Allowance. In the event that a person has purchased a Cruise Ticket Direct and later qualifies for a Cruise Ticket by winning an online poker tournament, Ladbrokes will refund the full cost of the direct purchase to the Qualifier’s account within five working days of the qualification. Please see the Direct Buy-in section for further details.
Winning or directly purchasing Cruise Tickets is subject to availability. Notwithstanding anything published or advertised to the contrary, Ladbrokes reserves the right to withdraw the Cruise Ticket as a prize in its on-line tournaments and to cease to allow the direct buy-in of Cruise Tickets at any time for any reason whatsoever.
2. The on-board Tournaments:
The minimum age limit for participants in any of the poker tournaments on board the Ladbrokes Poker Cruise III including the Main Event is 18 years old.
Tournament Rules: In addition to these Terms and Conditions, Ladbrokes Tournament Rules will apply, a copy of which will be available on board on request, and you agree to comply with the Tournament Rules at all times and understand that Ladbrokes reserves the right to amend the Tournament Rules at any time for any reason whatsoever.
Buying in: Unless you have pre-qualified, you may only participate in the tournaments by buying in for an entry fee as published for each tournament. Ladbrokes, reserves the right, in its sole and absolute discretion, to deny entry to any person to the tournaments and to exclude any player from the tournaments at any time for any reason whatsoever.
Buying in to tournaments once on board the Vessel will be through the use of a cashless ship system which shall be administrated by Cruise Operator. No cash, credit card transactions, or transactions from any Ladbrokes accounts will be taken by Ladbrokes for the duration of Ladbrokes Poker Cruise III.
Only Passengers who hold a Ladbrokes Cruise Ticket and Guests will be eligible to participate in the poker provided on board the Vessel by Ladbrokes.
Prize payments: All Multi-Table Tournament prize payouts will be credited to the participants’ Ladbrokes Accounts within ten (10) working days after the cruise is completed, that is, by Friday 15 February 2008. No cash alternatives will be given on board the Vessel or thereafter. Any Guest, who does not have a Ladbrokes account, is advised to open one in order to receive any payouts from Multi-Table tournament(s) held on board.
Tournament refunds: Any player who has pre-registered for a tournament, but is already participating in a previous tournament, will receive a full refund for the tournament that they can not participate in. Refunds will be paid directly into players Ladbrokes Poker accounts by Friday 8 February 2008.
Non Attendance:No refunds of poker tournament money will be made to you if you are unable to join the Vessel, for any reason whatsoever.
Non transferability: Non transferability: Places in the tournaments are not transferable.
Cash Games: All poker chips for cash games and single table tournaments, will be purchased from the casino cage on board the Vessel. Purchases of chips will be through the use of the cashless ship system administrated by Cruise Operator. All cash game winnings are the responsibility of the player and cannot be paid into Ladbrokes accounts on the Vessel, but may be credited back to your credit card or ship balance through the casino cage.
Cancellation: Ladbrokes has the right to cancel or re-schedule any tournaments for operational, commercial or any other reason whatsoever.
3. The Cruise:
Cancellation by the Cruise Operator: Should the Cruise Operator cancel or re-schedule the Cruise, it is agreed that Ladbrokes shall not be liable in any manner whatsoever to you.
Cancellation by Ladbrokes: Ladbrokes has the right to cancel or re-schedule Ladbrokes Poker Cruise III for operational, commercial or any other reasons. In the event of such cancellation, Ladbrokes shall make the following payments together with a refund of any sums paid to Ladbrokes for tournament entries on board the Vessel as Passenger’s sole remedy:
1. Qualifiers, or Passengers who received their Cruise Ticket by way of a transfer from a Qualifier made in accordance with these terms and conditions, shall receive following:
(a) refund of $3,800 to represent the cash value of the Cruise Ticket less the Travel Allowance if the cancellation occurs prior to date on which Ladbrokes has paid the Travel Allowance; or
(b) refund of $3,800 to represent the cash value of the Cruise Ticket less the Travel Allowance together with a refund any travel costs to and from New York demonstrably incurred in order to participate in the Ladbrokes Poker Cruise III, provided that such costs are non-refundable at the time of cancellation in the event that the cancellation ocuurs after the date on which Ladbrokes has paid the Travel Allowance. ; and
2. Passengers who have bought into the Cruise Ticket Direct in accordance with these terms and conditions shall receive a refund of the $3,800 paid for the Cruise Ticket together with a refund any travel costs to and from New York demonstrably incurred in order to participate in the Ladbrokes Poker Cruise III, provided that such costs are non-refundable at the time of cancellation.
Alcohol purchase and consumption: On board the Ship you will be required to abide by US law for alcohol purchase and consumption.
4. Liability of Ladbrokes as Promoter:
Notwithstanding what follows, Ladbrokes’ sole obligation in relation to Ladbrokes Cruise III shall be the organization and administration of the tournaments. Unless specifically provided for in these Terms and Conditions, Ladbrokes shall not be responsible or liable for providing any other item or service arising out of or in relation to the cruise, flights or accommodation and transfer arrangements. No other duty of Ladbrokes for your benefit, whether statutory, contractual or otherwise, shall be implied.
Ladbrokes shall at all times be responsible for the full and proper performance of its obligations hereunder. It is agreed that Ladbrokes will only be responsible for the actions of or omissions of its employees and agents if at the time of the failure to take such reasonable care and skill such employees and agents were acting within the course of their employment or within the scope of work agreed by Ladbrokes but it shall not be liable for failure of performance or improper performance which is wholly attributable to any or all of:
(a) your fault;
(b) the act or omission of a third party unconnected with the provisions of any services to be provided hereunder;
(c) unusual and unforeseeable circumstances beyond the control of Ladbrokes and/or the relevant supplier, the consequences of which could not have been avoided even if all due care had been exercised;
(d) any event which Ladbrokes and/or the relevant supplier could not even with all due care have foreseen or avoided, including (but not limited to) an event of force majeure.
(e) All carriage (by land, air and sea) is subject to the terms and conditions of carriage of the actual carrier which are expressly incorporated into these Terms and Conditions being your contract with Ladbrokes and which at the same time also form the terms and conditions of separate contracts between you as Passenger and the particular carrier as contained in that carrier’s ticket.
Carriage of passengers and their luggage by sea is governed by the Athens Convention 1974 (whether as subsequently amended or otherwise and hereinafter “the Athens Convention”). A copy is available on request. The Athens Convention is expressly incorporated into these Terms and Conditions and any liability of Ladbrokes for death of or personal injury or for loss of or damage to luggage arising out of carriage by sea shall be determined accordingly. In most cases, the Athens Convention limits the Carrier’s liability for death or personal injury or loss of or damage to luggage and makes special provision for valuables. It presumes that luggage has been delivered undamaged to you as the Passenger unless written notice is given to the Carrier:
1. in the case of apparent damage, before or at the time of disembarkation or redelivery;
2. in the case of damage which is not apparent or of loss, within 15 days from the date of disembarkation or redelivery or from the time when such redelivery should have taken place. Any damages payable by Ladbrokes up to the Athens Convention limits shall be reduced in proportion to any contributory negligence by you and by the maximum deductible specified in Article 8 (4) of the Athens Convention.
Insofar as Ladbrokes may be liable to you in respect of claims arising out of carriage by air or carriage by sea, Ladbrokes shall be entitled to all the rights, defects, immunities and limitations available, respectively, to the actual air carrier (including his own terms and conditions of carriage) and under the Athens Convention, and nothing in these Terms and Conditions shall be deemed a surrender thereof. To the extent that any provision in these Terms and Conditions is made null and void by the Warsaw Convention, the Athens Convention or any legislation compulsorily applicable or is otherwise unenforceable, it shall be void to that extent but no further.
Except for claims arising out of carriage by air, any liability in respect of death and personal injury and loss of and damage to luggage which Ladbrokes may incur to you, whether under our contract in accordance with these Terms and Conditions or otherwise, shall always be subject to the limits of liability contained in the Athens Convention.
Except in respect of death and personal injury, Ladbrokes shall in no circumstances whatsoever be liable for loss of profit or loss of business or any other form of consequential loss or damage, whether or not arising as a result of physical damage to property and regardless of the actual cause of such loss or damage.
Shore excursions and shuttle services are arranged by the Cruise Operator with local operators who may themselves engage the services of local suppliers. Ladbrokes will not be responsible for the performance of shore excursions and shuttle services.
Ladbrokes plc and/or subsidiary companies and all employees, agents, contractors and their sub contractors as well as all insurers of Ladbrokes shall have the benefit of the same rights, defences, immunities and limitations available to Ladbrokes under these Terms and Conditions, and it is agreed for this purpose that Ladbrokes contracts with you as agent or trustee for all such persons.
5. Insurance and Travel Information:
Insurance: All Passengers are solely responsible for arranging their own travel (flight and transfer arrangements) if you participate in this Promotion and for taking out appropriate personal travel insurance before departure. This must include as a minimum cover for the cost of cancellation by each Passenger and the cost of assistance including repatriation in the event of accident or illness. You are also solely responsible for ensuring that the insurance cover taken out by you is sufficient suitable and adequate for your individual needs having regard to the required scope and risks and to purchase additional or alternative insurance if required. We would recommend that you contact your travel agent or an independent insurance broker for details of suitable policies.
It is a condition of your Contract with Ladbrokes that you will take out insurance at your sole expense to cover yourself and all the members of your party and to be in force for the period from your embarkation on board the Vessel or your check-in for the outward flight preceding the cruise, whichever is the earlier, until your disembarkation from the Vessel or the arrival of your return flight at its destination following the cruise, whichever is the later.
Such insurance shall be of a comprehensive nature from a reputable insurer, and shall include cover for the following risks:
(a) Death or personal injury;
(b) Cancellation of the cruise;
(c) Theft or loss of or delay or damage to your property (including your baggage);
(d) Medical, dental, repatriation and other similar or related costs; and
(e) Additional accommodation or transportation costs (not provided for in our contract).
Any costs, liabilities or charges reasonably incurred by Ladbrokes for or on your behalf in respect of any medical, dental or similar care, repatriation, accommodation or transportation not provided for in these Terms and Conditions or any other expense shall be repaid by you to Ladbrokes on demand, whether or not such sums are recoverable by you under your insurance.
New Regulations: New Regulations have recently been passed in the USA which require cruise lines to obtain information about guests in advance of their cruise taking place. Without this information the Cruise Operator will not be able to give authorisation for you to join the cruise. You must, therefore, complete the on-line registration form you will be sent upon qualification or entry. If you qualify before March 2007 you will not be required to submit this information until April 2007. All information must correspond with your passport or travel documentation. If you fail to supply the details requested for you and your guest fully and accurately, you may not be permitted to board the Vessel and/or outward and/or return flight. All passenger information (lead name and guest) must be supplied via the on-line registration form by November 25 2007 latest to enable us to issue your Cruise tickets.
We trust you appreciate the need for us to comply with this regulation in the interests and safety of all participants, guests, passengers and crew. Ladbrokes will not accept any liability for your failure to comply with these new Regulations. You are solely responsible for your outward / return travel arrangements. If failure to have this information results in fines, surcharges or other financial penalty being imposed on Ladbrokes, you will be responsible for reimbursing us accordingly.
Travel documentation, Visa, Information and Health Requirements: It is your sole responsibility to identify all travel and health documents and to be in possession of all necessary appropriate valid travel and health documents for you and your guests before departure. This includes passport, visas, inoculation and family legal documents. You must pay all costs incurred in obtaining such documentation. If failure to have any necessary travel or other documents results in fines, surcharges or other financial penalty being imposed on us, you will be responsible for reimbursing us accordingly. Failure to present the necessary documents and/or visas at the airport / pier / ports of call could result in denied boarding. We are unable to guarantee your place in the Tournament if you are unable to bring proper documentation.
Passports: For non-US citizens, valid passports and visas (including multiple Entry Visas, where applicable) are required. Please check entry requirements for your destination with your local passport office. We have given some guidelines below, but it is your responsibility to ensure your paperwork meets all these requirements.
If you are a British citizen (including children and infants), you must have your own full 10 year (5 year for children) British Passport which is valid for at least 6 months after your expected return date to the UK. It is no longer possible for children to be included on their parent’s passport. Obtaining a full British passport presently takes approximately 4 weeks, but you should allow longer at busy times of the year.
New Entry Requirements to the US: If you are travelling to the USA under the Visa Waiver Program you and all members of your party (including children) must ensure that your passport is machine readable. Anyone travelling to the USA under this Programme without a machine readable passport will need a visa to travel to the USA.
A British passport is machine readable when there are two lines of letters, numbers and chevrons (“>>>>>”) printed across the long edge of the personal information page (the page with photograph and personal details). The machine-readable text will appear on a white strip on older passports and directly on the pink page of newer passports. If there are no such lines of text on the personal information page, the passport is not machine-readable. Since 26 October 2004, anyone travelling to the USA under the Visa Waiver Programme without a machine readable passport needs a visa to travel to the USA. If you are travelling to the US after October 2005 under the Visa Waiver Programme and are carrying a passport issued after this date, you will be required to have a biometric passport. British travellers with valid machine-readable passports issued before October 2005 travelling to the US under the Visa Waiver Programme can travel on their existing passport up to, and beyond, October 2005. For more details on passports, please ask at the time of booking or contract the UK Passport Office.
Please note: Certain persons may not be eligible to enter the United States visa free under the Visa Waiver Programme. These include for example people who have been arrested, even if the arrest did not result in a criminal conviction and those with criminal records, (the Rehabilitation of Offenders Act does not apply to U.S. visa law) etc. If you are in any doubt whatsoever as to whether you can travel under the Visa Waiver Program you are strongly advised to contact the Consular Information unit, United States Embassy, 24 Grosvenor Square, London W1A 1AE or visit www.usembassy.org.uk before you book your holiday with us.
On 2 April 2004 the US announced that it would extend US-VISIT arrival procedures to all passengers, including those travelling under the Visa Waiver Programme (VWP), from 30 September 2004. This means that passengers arriving in the US will have a digital photograph taken, and have inkless digital scans taken of their index fingers. If you would like further information, please ask at the time of booking or contact the UK Passport Office or US Embassy. Please note this information is particularly subject to change, and you must check the up to date procedure in good time before departure.
If you are not a British Citizen or do not hold a British Passport you must check the applicable passport and visa requirements with the Embassies of the Countries that you will be visiting during your holiday. You must ensure the name (including initials) is exactly the same as it appears on your ticket as in your passport. If there is any difference, you may be refused entry onto your flight/cruise.
Passport and visa requirements may change and vary by destination. You should check the up-to-date position with either your travel agent and/or with the appropriate Embassy. We regret we cannot accept any liability if you are refused entry onto any flight or into any country, or otherwise suffer any difficulties or incur any costs as a result of not having the correct passport and/or ay required visa(s).
Certain Port Authorities may from time to time ask to see a photo identification when you depart the ship during the cruise. We strongly suggest that you take a photocopy of your passport in addition to your passport itself with you on holiday and carry the photocopy with you each time you depart the ship in order to minimise the inconvenience this may cause.
Health / Inoculation: You must ensure that you are medically and physically fit for travel. The Centres for Disease Control (CDC) www.cdc.gov/travel and the World Health Organization (WHO) www.who.int/vaccines-diseases, provide guidelines as to which vaccinations are required in each country. In many cases inoculations are recommended but in some circumstances they are required. You should check with your health care professional for guidance. Please contact your G.P. for advice and the most up-to-date health requirements for all destinations of the cruise. Information on health is also contained in the department of Health leaflet T6 (Health Advice for Travellers) available from your local Department of Health Office and most Post Offices. For European holidays you should obtain a completed and issued Form E111 (details in leaflet T6 referred to above) prior to departure.
Refusal to travel: If in the opinion of the Cruise Operator or the opinion of the Ship’s Master or doctor, it appears that a Passenger is or is likely to become unfit to travel for any reason or be or likely to become a risk or danger to themselves or others or any property or behave in such a way so as to cause or be likely to cause upset, distress or disturbance to any third party, the Cruise Operator and the Ship’s Master is entitled to, without prior notice, to refuse to allow any Passenger and their guest to travel and to terminate his/her cruise at any time. In such circumstances the Passenger will be liable for any costs, liabilities, expenses, taxes or other costs that result from such termination and Ladbrokes will not pay any compensation or refund in respect of such termination. Following such termination, Ladbrokes as Promoter will have no further responsibility or duty towards the Passenger and he/she should address any rights of redress against the Cruise Operator.
Pregnancy: Any female who is more than 27 weeks pregnant by the beginning of the date of intended travel will not be allowed to travel. It is a further condition of the Promotion that if you are or will become at any time during the Cruise between 24 and 26 weeks pregnant you will provide to Ladbrokes prior to the commencement of the Cruise a letter from your general practitioner confirming that you are fit to travel. This must be sent to us at least 30 days before departure. You are invited to consult your doctor prior to departure for the most recent guidance on travel for pregnant women. Security measures: Due to enhanced procedures by the United States Immigration and Naturalization Service, guests departing the ship at the end of their cruise may be subject to possible delay. You may also experience long delays coming through Immigration on arrival. Due to increased airport security measures, please ensure that any sharp items, including scissors, razor blades, nail clippers, tweezers and knitting needles are packed in your check-in luggage and not your hand luggage.
Luggage: The amount of luggage admissible to be taken on the Cruise will be subject to both the terms and conditions of the Cruise Operator and the airline responsible for the outward and inbound flights preceding and following the Cruise. The luggage allowance permitted by most non-scheduled flights is 20kg and any fees or charges payable for the transportation of luggage in excess of the lower of the maximum prescribed by the Cruise Operator and/or any airline responsible for any outward or inbound flight will be solely for your account.
